These Terms and Conditions of Trade (Terms) apply each time you purchase Goods from BONNO NZ Limited (NZBN 9429052200045) (BONNO, we, us) (and any of its subsidiaries or related entities), unless we agree otherwise in writing.
By purchasing Goods from us, you accept these Terms and agree that these Terms will apply to the supply of all Goods by us to you from time to time.
We may vary, update or replace these Terms by publishing any variations, updates or replacements on our website – www.bonno.nz.
All varied, updated or replaced Terms published by us will take effect from the date of publication, and will apply to all purchases of Goods by you from us from the date of publication onwards. We recommend you review these Terms each time you visit our Website or before you purchase Goods from us.
In these Terms (unless the context requires otherwise):
Consumer Law means the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, and all related regulations and codes of practice;
Goods means any goods supplied by us to you, including but not limited to the BONNO Chew(s);
GST means New Zealand goods and services tax, payable in accordance with the New Zealand Goods and Services Tax Act 1985;
Liability means all costs, claims, demands, damages, expenses, losses and liabilities of whatsoever nature including any third party claims;
Order means any written or oral request from you to us for the provision of Goods, which is subject to acceptance by us;
Specifications means any instructions and/or specifications relating to the Goods, which are provided by us to you and/or are available at www.bonno.nz;
Website means www.bonno.nz; and
Working Day means any day other than a Saturday, Sunday or a public holiday observed in Auckland, New Zealand.
Advertising and Information: Any advertising or information relating to our Goods and contained on our Website or provided at one of our in-person marketplaces, constitutes an invitation to treat only, and is not an offer to supply any Goods.
Offer to Purchase: When you place an order with us to purchase Goods, you are making an offer to purchase Goods in accordance with these Terms.
Acceptance of Orders: We may choose to accept your order by arranging for the processing of your payment and the delivery of the Goods.
Website Orders: An order is placed on our Website by adding Goods to the shopping cart and proceeding through our checkout process. You will be required to provide us delivery details, enter payment information and submit your order. Once the checkout process has been completed, you will be presented with a confirmation page with full details of your order, which you are able to print as a receipt of your order.
Payment Methods: For orders placed on our Website, you may pay online by [Visa, MasterCard, American Express, JCB or China UnionPay. Additional payment options include ApplePay, GooglePay, and BONNO Gift Cards. For Goods purchased at our in-person marketplaces, you may also pay by cash.
Right to Refuse: We reserve the right to cancel or to refuse to fulfil any order or any part of an order for any reason. Without limitation this may include:
Stock Availability: where the Goods displayed on our Website or at our in-person marketplaces are no longer in stock;
Misdescription: where there has been an error in the listing of the Goods (i.e. an incorrect price, image or description of Goods);
Commercial Resale: where we believe the order has been placed for commercial purposes (i.e. any kind of commercial resale);
Fraud: where we believe an order may have been placed fraudulently, including where we believe there may have been credit card or payment related fraud; and
Item Limits: where the quantity of Goods ordered (whether in a single or multiple transaction) exceeds our quantity [or discount limits] for those Goods. We may set quantity or discount limits as we see fit and will publish those in relation to the Goods affected on our Website.
Non-supply: If we cancel your order or are unable to supply the Goods requested, we will process a refund to the value of the non-supplied Goods and attempt to notify you to confirm the refund.
Returns: Although we hope your dog loves its BONNO, set out below is out returns policy if you (or your dog) are not completely happy with your purchase.
Returns Policy: We will provide a full refund, size exchange or credit note for all full-price Goods that are:
returned to us in the same unused and undamaged condition and in the original packaging that you received them in;
returned to us within thirty (30) days of your online order being submitted to us; and
returned to us with your proof of receipt of purchase at your own costs (any shipping costs are non-refundable and not included in the refund amount).
Returns Process: To start a return, you can contact us at info@bonno.nz. Goods that are not notified to us will not be accepted.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned Goods. We will also notify you of the approval or rejection of your returned Goods.
If approved, your refund will be processed, and a credit of the original purchase price of the Goods returned will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Health and Safety: For health and safety reasons, we cannot accept any Goods that are not in their original packaging or have been trialled by your dog.
Consumer Guarantees Act: These Terms do not limit any consumer rights available to you under the Consumer Guarantees Act 1993 (including in relation to faulty products) which are unable to be excluded by law.
Delivery: All orders that require delivery are subject to our delivery and shipping terms set out below:
Costs: All Goods shipped are subject to such additional postage costs as advised to you at the time of checkout.
Flat Rate: We currently offer a flat rate postage fee of $7.50 within New Zealand per package – this includes rural delivery.
Timeframe: We aim to have standard delivery orders dispatched within 1-3 Working Days and then once picked up our courier partners can take up to 7 Working Days to deliver. We will get in touch with customers if their order has had a significant delay.
Shipping Updates: Once your order has been dispatched from our warehouse, you will be sent an email to confirm your order is on its way to you, including the tracking details.
Delivery Instructions: Please provide any specific delivery instructions during the checkout process.
Overseas: We currently only deliver within New Zealand and do not ship internationally at this stage.
Liability: You acknowledge that we are not responsible for your Goods once they are shipped from our warehouse using a courier service. Although we will use all reasonable endeavours to assist you to liaise with the courier service, BONNO will not be liable for lost packages or for damage to your Goods as a result of the shipping or delivery process – all Goods are shipped at “owner’s risk” for the purposes of the Contract and Commercial Law Act 2017.
Click & Collect: The following terms apply to all Click & Collect orders:
Collection Fee: There is no additional fee for click and collect orders however click and collect is offered at our sole discretion and is available by prior arrangement only;
Location: Click and collect Goods may be collected from our Kerikeri location (or at one of our marketplaces) between the hours of 10am – 3pm on a Working Day arranged in advance with us;
Notice Required: We require a minimum of one (1) Working Days’ notice in order to ensure your Goods are ready for you to collect;
Forfeiture: Goods that are not collected within fourteen (14) Working Days from the date of purchase will be forfeited and we shall be under no obligation to refund you for the Goods.
Pricing: All prices displayed on our Website or in-store are in New Zealand Dollars (NZ$) and are inclusive of GST (unless otherwise stated). For orders through our Website, the price charged for Goods will be the retail price displayed on the Website at the time you submit your order, subject to these Terms.
Accuracy: While we endeavour to ensure prices listed on our Website or in-store are accurate as at the time of publication, we do not provide any warranty as to the accuracy of any listed price, and reserve the right to correct any errors, inaccuracies or omissions or to change or update any price or other information without prior notice to you. Our pricing at our in-person marketplaces may differ from prices displayed on our Website.
Third Party Pricing Lag: Where we update prices on our Website or in-store, these updates may not be immediately reflected on third party product and price aggregator platforms (such as Google Shopping). You acknowledge that the price displayed on our Website or in-store will prevail over any price provided by a third party product and price aggregator.
Additional Fees: All orders that require delivery are subject to additional delivery and shipping fees. Please see our Delivery and Shipping terms above for further information.
Promotions: Goods advertised by us may be subject to discounts and promotions. Please see the terms and conditions attached to the discount or promotion or contact us for further information.
Process: When your order is submitted through our Website, your nominated payment method will be debited. Subject to these Terms and the successful debit of your nominated payment method, the Goods you have ordered from us will be prepared and despatched to your nominated shipping address.
Checks: Card transactions may be subject to fraud management checks, to help protect our customers and reduce our exposure to fraud. We may hold your order for approval before your order is confirmed. Your order will be accepted once we are satisfied the transaction can be confirmed as legitimate. We reserve the right to reject any order where you are unable to verify your payment method or do not respond to any of our reasonable concerns.
Payments: It is critical to us that your payment information is secure. We use the secure Hosted Payment page solution from Stripe to process online orders. All payments made via our Website are processed in an SSL (Secure Socket Layer) environment where information is encrypted to protect your privacy.
Online Fraud: despite our best attempts, you understand that by submitting your payment information online, and choosing to use one of our payment options, such information may be susceptible to fraud and/or misuse by unauthorised third parties. We shall not be liable for any loss, costs, damages or injury you suffer as a result of your choice of payment option and your use of our online payment systems.
Product Specifications: All product dimensions and specifications relating to Goods sold by us are approximate only. As our Goods are made from natural products, each BONNO stick is individual and therefore general product dimensions and specifications may change from stick to stick.
Stock Availability: Goods displayed on our Website are subject to availability. We take all reasonable steps to provide accurate stock availability information on our Website, however we do not guarantee that Goods classified as “in stock” will be available to purchase at our in-person marketplaces or online.
Inaccurate Product Information: Where Goods purchased by you do not correspond with any description provided by us, you may be eligible to return the Goods to us subject to our Returns and Exchanges terms set out above.
Website Disclaimers: please read our website disclaimers in our Website Terms of Use carefully as they apply to any Goods purchased under these Terms from our Website.
Prohibition on Use: You are not permitted to copy, reproduce, alter, modify, create derivative works, publicly display, broadcast or stream any content from our Website, without our prior express written permission. You may not create and/or publish your own website that features content from our Website (e.g. our Goods, prices, content or product listings) without our prior written permission. You may not extract and/or utilise parts of the content of our Website and in particular, you may not utilise any data mining, robots or similar data gathering and extraction tools without our prior written permission.
Indemnity: You agree to indemnify and hold harmless us, our directors, employees, agents, contractors and affiliates, from and against any losses, damages, costs, liabilities and expenses (including legal expenses), and any claim or demand made by any third-party due to, or arising out of, your breach of these Terms.
Warranties: Except to the extent required by law and as otherwise provided in these Terms, we provide no warranties to you in respect of the Goods.
Exclusion: To the maximum extent permitted by law, we, our directors, employees, agents, contractors and affiliates will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including (without limitation) lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of our Website, our online store, or any Goods purchased from us (or any damage caused to your dog or any third party as a result of our Goods), or for any other claim related in any way to your use of our Website or any Goods, including (but not limited to) any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of our Website or any Goods.
Force Majeure: We will not be liable to you for any delay or non-performance of our obligations to the extent that such delay or non-performance is caused by an event or circumstance which is outside our reasonable control.
Limitation: To the maximum extent permitted by law, where we or any of our directors, employees, agents, contractors and affiliates are found liable to you for any reason notwithstanding these Terms, our maximum aggregate liability to you will be limited to the price paid by you for the relevant Goods.
Business Purpose: If you are acquiring goods or services from us for business purposes, the Consumer Guarantees Act 1993 and sections 9, 12A and 13 of the Fair Trading Act 1986 will not apply.
Consumer Guarantees Act: These exclusions do not affect any consumer rights which may not be excluded under the Consumer Guarantees Act 1993.
Personal Information: The security of your personal information is important to us.
Privacy Policy: You agree that we may collect, hold, use and disclose personal information provided by you for the purposes set out in our Privacy Policy.
Correction: Where we hold personal information, you have the right to request access to, and correction of, such personal information. Refer to the privacy policy above for more information.
Notice: If a dispute, disagreement, question, difference or claim arises between the parties in connection with a Contract, or in relation to any question regarding its existence, breach, termination or validity (Dispute), either party may give the other written notice requiring that the Dispute be determined in accordance with this clause (Dispute Notice).
Negotiation: The parties will negotiate in good faith for a period of 10 Working Days from the issue of the Dispute Notice towards resolution of the Dispute.
Escalation: At the expiration of 10 Working Days from the date of the Dispute Notice, unless the Dispute has otherwise settled, either party may take any action relating to the Dispute as it sees fit, including in a Court of competent jurisdiction.
Obligation to continue to perform: Notwithstanding the existence of a Dispute, each party will continue to perform its obligations under the relevant Contract.
Urgent relief: Nothing in these General Terms or any Contract will prevent either party seeking any order or relief by way of injunction or declaration or other equitable or statutory remedy against the other party where such party reasonably believes such order or relief is necessary for the urgent protection of its rights or property.

Entire agreement: These Terms represent the entire understanding between us and supersede all previous agreements and understandings between us and you relating to the sale and purchase of the Goods.
International Users: Our Website is operated by us from New Zealand. The information on the Website may not be appropriate or available for use in other jurisdictions. If you choose to access our Website from a jurisdiction other than New Zealand, you acknowledge that the products purchased by you may not comply with consumer laws in your country and we will not be responsible for compliance with any applicable laws of that jurisdiction.
Severability: If any provision of these Terms is held by any court to be illegal, void or unenforceable, such determination will not affect the enforceability of the remaining provisions of these Terms.
No Waiver: Any failure or delay by us to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
Enforceability: If any part of these Terms are held to be unenforceable, the part concerned will be deleted or modified to the minimum possible extent necessary to enable these Terms to remain enforceable.
Enforcement Costs: You will reimburse us for all costs and expenses (including legal fees) incurred by us in exercising any of our rights under these Terms.
Governing law: Each order of Goods will be governed by the laws of New Zealand and the parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the New Zealand courts.
